Hire terms

These terms, the equipment and price selected on the booking form, and the customer’s required acceptance together form the online Hire Agreement. Departure and return condition are recorded separately.

Excavator handover condition: M&M will not release the excavator until the required dry-hire cover and handover conditions are confirmed. If M&M cannot supply the booked machine, the customer may choose a full refund or suitable transfer.

1. Who the agreement is with

The owner is Madelaine Rose Mackenzie, trading as M&M Regional Hire(ABN 72 671 206 346), referred to as M&M. The hirer is the person or entity named in the signed Hire Agreement. The person signing confirms they are authorised to do so.

2. Booking and payment

A booking is confirmed only after M&M accepts it and the stated online booking total has cleared. Online equipment bookings are paid in full at checkout, including any selected delivery or cleaning formula. The transport trailer is automatically included with an excavator hire for $0 extra. The exact refundable security bond is charged in the same transaction but shown as a separate Stripe checkout line. Quotes remain subject to availability, access, identification, towing suitability and any equipment-specific conditions stated before confirmation. Prices are in Australian dollars and GST is not charged.

3. Security bond

The refundable bond is $250 for the excavator, $50 for the standalone trailer, $50 for either cleaner and $75 for the pressure washer. An excavator booking with the included transport trailer has one $250 bond, not two bonds. Garden tool bonds are shown with each listed rate and confirmed in the enquiry before payment. The bond is not an extra hire fee. It is received in the same card payment, identified separately on the receipt and tracked separately in M&M's booking records. After a clear return inspection and condition-photo record, M&M will initiate a full refund to the original payment method. Banks usually show the refund within 5–10 business days. If a deduction may be properly payable—for example documented damage, loss, missing items, extra engine hours, refuelling or cleaning—M&M will provide evidence and an itemised explanation before returning the remaining bond. The bond is not automatically forfeited.

Timber moisture testing and full-system vehicle scans are M&M-operated call-out services, not dry hire. Travel and service charges are quoted and agreed before the visit; the call-out enquiry does not take a payment or hire bond. Vehicle scans provide preliminary information and a report only—no repairs, roadworthy inspection, coding, programming or calibration are included.

4. Identification and competency

Valid current photo ID must be sighted and matched to the named hirer at pickup or delivery before equipment is released. A valid driver licence must be sighted for trailer hire and customer self-tow. The named hirer must be present when M&M delivers equipment. Any competency evidence reasonably required for the equipment or work must also be shown. Only competent, authorised operators named or approved for the booking may use the equipment. M&M records that ID was sighted; routine licence photographs or scans are not collected.

5. Safe and lawful use

  • Use equipment only for its intended purpose and within manufacturer limits.
  • Complete a site risk check and locate underground services before digging.
  • Do not use while affected by alcohol, drugs, fatigue or an unsafe condition.
  • Keep people clear of operating, slewing, loading and unloading zones.
  • Do not sub-hire, modify, overload or remove safety devices.
  • Stop work and contact M&M if a fault, warning, incident or unsafe condition appears.

6. Site and underground services

The hirer controls the work site and is responsible for safe access, ground conditions, overhead hazards, underground services, permits and lawful disposal. Before digging, obtain current plans through Before You Dig Australia and use suitable on-site locating methods; plans alone may not identify the exact position or depth of services.

7. Hire period and engine hours

A day includes up to eight engine hours, a weekend up to sixteen, and five days up to forty. Start and return times are shown on the schedule. Any approved extra hours or late return charge must be stated or reasonably calculated and itemised before deduction.

For the carpet cleaner, steam cleaner and pressure washer, the 24-hour, weekend and seven-day packages last 24, 48 and 168 hours respectively from the actual handover. The customer requests a daytime handover time at booking; M&M confirms the exact pickup or delivery time before handover. Return is due when that period ends, including across a daylight-saving change. The online calendar reserves every date touched by the hire, including the return date, so a second hire cannot overlap it.

Garden tools can be booked through the live online calendar. The 24-hour, weekend and seven-day packages run for 24, 48 and 168 hours from the agreed handover time. The selected tool and supplied kit are reserved together after secure payment, and M&M confirms the exact pickup or delivery time before handover.

8. Fuel, cleaning and biosecurity

The excavator is supplied full and must be returned full with the correct fuel. Equipment, trailer and attachments must be returned free from mud, soil, concrete, vegetation and rubbish. The hirer pays only the actual reasonable refuelling, cleaning or decontamination cost caused by a failure to meet these requirements.

Petrol garden tools are handed over with a tank of the correct M&M-supplied fuel included in the hire rate. Do not add your own fuel or engine oil to the fuel tank. Arrange additional fuel with M&M before the tank runs low; any extra fuel charge is agreed before supply. These tools do not have an excavator-style full-to-full return rule. Battery garden tools are supplied with the compatible battery and charger identified on the tool listing, subject to the confirmed handover kit.

The chainsaw and pole saw also need bar and chain oil in their separate oil reservoirs. M&M checks that oil at handover and explains the approved oil and how to check its level. Stop cutting and contact M&M if that oil runs low and none is available.

9. Carpet-cleaner formula

Carpet-cleaner hire includes two labelled 60 mL standard full-tank doses of approved formula. Any extra two-dose pack selected during booking is supplied in labelled containers. Only formula supplied or specifically approved by M&M may be used in the machine. Do not add household detergent, bleach, oils, vinegar or another unapproved product. Return the supplied dose containers with the machine so the handover kit can be checked.

10. Delivery, collection and towing

Delivery zone prices are estimates until the address and access are checked. For customer pickup, the hirer must present a tow vehicle, licence, towbar, ball, electrical connection, brake controller and ratings suitable for the trailer and actual load. M&M may refuse an unsafe combination and refund unused hire payments.

11. Care, loss and damage

The hirer must take reasonable care, secure the equipment against theft and follow the handover instructions. Liability is limited to loss or damage the hirer is legally responsible for, subject to consumer law. Ordinary fair wear, pre-existing damage and loss caused solely by M&M are not charged to the hirer.

12. Breakdown and incidents

Stop using the item, make the area safe and call 0434 514 801. Do not arrange repairs without approval except urgent action reasonably needed to prevent injury or further loss. Report theft, collision, property damage, injury or service strikes immediately and provide truthful photos and information reasonably needed for M&M's records or the authorities.

13. Return and inspection

Both parties should complete the return side of the handover checklist and photo record. If a hidden issue cannot reasonably be identified at handover, M&M will notify the hirer promptly with evidence. The bond is not automatically forfeited.

14. Cancellation

The separate Cancellation Policy forms part of these terms. It allows fair rescheduling and limits deductions to clearly stated, reasonable loss or costs rather than an automatic penalty.

15. Consumer law and privacy

Nothing excludes rights that cannot legally be excluded under the Australian Consumer Law. Personal information is handled as described in the Privacy Policy. South Australian law applies, subject to any law that must apply elsewhere.
